HELOC and refinance packages share many core forms, yet they differ in the number of pages, notarized documents, and post-signing requirements. A refinance commonly includes a Deed of Trust that must be notarized, plus lender and title affidavits that may require jurats. A HELOC often has fewer notarized pages but can include bank-specific riders and disclosures that require initials throughout the set.

• ID and name matching: Both package types require valid government issued ID that matches vesting. Some lenders request two forms of ID for HELOCs. We follow the assignment directions precisely.
• Notarized pages: Refinance sets almost always include a notarized Deed of Trust. HELOC sets may include a Deed of Trust or a similar security instrument depending on the lender. Affidavits that require a jurat appear in both package types when instructed by escrow.
• Right to Cancel: Both often include Notice of Right to Cancel for each borrower where applicable. The number of copies and initials are controlled by lender instructions.
• Scan backs and drop: HELOC assignments frequently request same-day scan backs before drop. Refinance files may require partial or full scan backs. We provide clean scans and carrier drop with tracking.

When the Grantor is a Trust, LLC, or Corporation, the signer must show both identity and authority to sign for that entity.

• Trusts: A recent Trustee Certificate or Certification of Trust naming the acting trustee(s).
• LLC/Corporation: An Operating Agreement or Corporate Resolution that gives the manager, member, or officer power to sign the easement.
• Document match: The title printed near the signature line should match the capacity shown in your paperwork, for example “Jane Doe, Trustee.”
• Recording readiness: We complete a Nevada acknowledgment that reflects the signer’s capacity so the Recorder can index the instrument correctly.

An encroachment release is used when a structure such as a fence, wall, shed, or landscaping sits inside a recorded easement corridor. The release acknowledges the condition and preserves the utility’s right to access the area in the future.

• What it covers: Identifies the encroaching improvement, sets access terms, and clarifies who pays to move or replace the item if maintenance requires removal.
• Why it is notarized: The release affects property rights and is recorded with the county. A proper acknowledgment allows the Recorder to accept and index it.
• Who signs: The owner of record or authorized representative. A utility, HOA, or developer may countersign depending on the form.
• Practical tip: Attach a clear exhibit map that matches the legal description to prevent rejection.
