Client-Directed Justice Court Motion Practice
Lake Mead Mobile Notary prepares client-directed motions, oppositions, replies, and other specifically identified written responses for self-represented parties in existing Las Vegas Justice Court civil or small claims cases.
This service begins after:
- A case has already been opened
- The customer has selected the type of motion or response
- The customer can identify the relief being requested or opposed
- The customer can supply the factual content
- Any legal arguments or authorities have been selected by the customer or a qualified attorney
- The applicable deadline and hearing requirements have been identified
- The complete relevant case documents have been provided
A motion can materially affect claims, defenses, deadlines, evidence, judgment, property, or the outcome of a case. Lake Mead Mobile Notary does not decide whether a motion should be filed or whether opposing, replying, settling, appealing, or taking another action is the best legal strategy.
Documents This Page May Cover
Depending on the current forms, case type, and accepted scope, this page may cover:
- Motion
- Opposition to a motion
- Reply in support of a motion
- Written response to a court notice or procedural request
- Supporting declaration
- Supporting affidavit
- Memorandum of points and authorities based on customer-supplied content
- Statement of facts
- Exhibit index
- Exhibit attachment set
- Proposed order
- Certificate of service
- Notice of Entry of Order
- Other related motion-practice documents expressly included in the confirmed scope
These document types belong to one existing-case motion-practice service. Motions, oppositions, replies, and supporting documents should not become separate CMS pages solely because they occupy different positions in the same briefing sequence.
What a Motion Is
A motion is a written request asking the court to make a ruling or enter an order concerning an issue in an existing case.
The motion should identify:
- Court
- Case number
- Parties
- Moving party
- Specific relief requested
- Factual grounds
- Applicable procedural grounds
- Supporting evidence
- Supporting legal authorities when required
- Requested hearing or submission procedure
- Signature
- Service information
The customer must independently identify what the court is being asked to do.
Lake Mead Mobile Notary does not select the motion, requested relief, legal grounds, or procedural strategy.
What an Opposition Is
An opposition is a written response explaining why the court should deny, limit, modify, or otherwise decline to grant a motion filed by another party.
An opposition may address:
- Facts stated in the motion
- Facts omitted from the motion
- Customer-supplied corrections
- Customer-selected objections
- Documents submitted by the moving party
- Customer-supplied exhibits
- Legal arguments supplied by the customer or attorney
- Alternative relief requested by the responding party
- Other issues directly raised by the motion
The customer must provide the complete filed motion and every attachment.
Lake Mead Mobile Notary does not determine:
- Which arguments should be opposed
- Whether an assertion is legally sufficient
- Whether an objection has been preserved
- Which factual disputes are material
- Which authorities control
- Whether the customer should concede any portion of the motion
- Whether a separate motion or counter-request should be filed
Current self-help guidance warns that failing to file a written opposition may allow the judge to grant the motion without considering an opposing written position. The actual deadline and consequences must be verified from the motion, hearing notice, applicable rules, and case circumstances.
What a Reply Is
A reply is generally filed by the moving party after receiving an opposition.
The reply ordinarily addresses matters raised in the opposition and supports the relief requested in the original motion.
The customer should provide:
- Original motion
- Every attachment to the motion
- Filed opposition
- Every attachment to the opposition
- Customer-supplied response to the opposition
- Additional authorities supplied by the customer or attorney
- Filing and service deadline
- Hearing information
Current self-help guidance cautions that a reply ordinarily should respond to the opposition rather than introduce unrelated new arguments or evidence. Whether particular content is permitted requires review under the current rules and circumstances.
Lake Mead Mobile Notary does not decide whether a reply is necessary or which arguments should be included.
Other Written Responses
The word “response” in this service is limited to a specifically identified procedural document in an existing case.
A response may involve:
- Response to a court notice
- Response to an order requesting information
- Objection to a defined request
- Response to a motion-related filing
- Supplemental statement authorized by the court
- Other current court form selected by the customer
This page does not absorb:
- Civil Answer Preparation
- Small Claims Answer or Counterclaim Reply
- Tenant Summary Eviction Answer Preparation
- Discovery responses
- Responses to interrogatories
- Responses to requests for production
- Responses to requests for admission
- Appeal briefs
- Criminal responses
- Protection-order responses
- Administrative-agency responses
Those transactions use different forms, deadlines, and procedures.
Current Generic Forms
Current self-help resources provide generic Justice Court forms for basic motion practice, including:
- Generic Justice Court Motion
- Generic Justice Court Opposition
- Generic Justice Court Reply
- Generic Justice Court Order
- Justice Court Notice of Entry of Order
A generic form may require substantial modification for the particular motion, case, requested relief, and applicable rule.
Lake Mead Mobile Notary may prepare a generic form only when:
- The customer has selected it
- The requested relief is clearly defined
- The customer supplies the supporting facts
- Required legal authorities are supplied by the customer or attorney
- The current court requirements can be administratively identified
- The matter remains within the accepted preparation scope
The availability of a generic form does not mean every type of motion can be safely or adequately presented through that form.
Specific Motion Forms
Las Vegas Justice Court and the Civil Law Self-Help Center may publish specific forms for certain matters.
Depending on the case type, current forms may address matters such as:
- Setting aside default
- Setting aside default judgment
- Setting aside dismissal
- Continuing a hearing
- Summary judgment
- Satisfaction of judgment
- Release of execution
- Exemption-related proceedings
- Mediation-related requests
- Placing a small claims matter on calendar
- Certified-mail service requests in small claims
- Other court-specific relief
Specific forms are variations within this Motion, Opposition, or Response Preparation service. They do not require separate CMS pages.
Each request must still be qualified because the existence of a form does not establish:
- That the form applies
- That the customer qualifies
- That the motion is timely
- That the requested relief is legally available
- That required facts exist
- That supporting evidence is sufficient
- That the customer should file it
Motion Type Must Be Customer Selected
Before preparation begins, the customer must identify the motion or response type.
Lake Mead Mobile Notary may:
- Identify the titles of current public forms
- Compare the selected form title with the customer’s request
- Ask for missing administrative information
- Organize customer-supplied content into the selected form
- Pause work when the requested document remains unclear
- Refer the customer to current self-help or attorney resources
Lake Mead Mobile Notary does not:
- Choose the motion
- Recommend the motion
- Determine which rule applies
- Decide what relief should be requested
- Select the legal grounds
- Determine whether another filing is preferable
- Advise whether the motion will succeed
Requested Relief
A motion should state what the customer wants the court to order.
The requested relief may involve:
- Changing a deadline
- Continuing a hearing
- Setting aside a default
- Setting aside a judgment
- Reopening a dismissed matter
- Compelling a procedural action
- Limiting or excluding a request
- Correcting a record
- Declaring a judgment satisfied
- Releasing an execution
- Resolving a disputed issue
- Granting another customer-selected form of relief
The customer must describe the requested result precisely.
Lake Mead Mobile Notary does not determine:
- Whether the court has authority to grant it
- Whether the request is legally available
- Whether alternative relief should be requested
- Whether the request is too broad
- Whether another motion is required
- Whether the requested order could create unintended consequences
Customer-Supplied Factual Grounds
The customer must supply the facts supporting or opposing the request.
Useful factual information may include:
- Procedural history
- Filing dates
- Service dates
- Hearing dates
- Court orders
- Communications
- Payments
- Contract events
- Discovery history
- Settlement history
- Default circumstances
- Reasons for delay
- Efforts to comply
- Prejudice claimed by either side
- Other facts connected to the motion
Lake Mead Mobile Notary may improve:
- Organization
- Chronology
- Grammar
- Headings
- Formatting
- Readability
Lake Mead Mobile Notary may not:
- Invent facts
- Change the customer’s meaning
- Add unsupported accusations
- Conceal unfavorable information
- State facts as personally known when they are not
- Create a legal theory
- Misrepresent the record
- Predict how the court will evaluate the facts
Memorandum of Points and Authorities
A motion or opposition may require a memorandum explaining the factual and legal basis for the requested ruling.
Current Las Vegas Justice Court rules address memoranda supporting motions and authorize the court to deny unsupported requests.
Lake Mead Mobile Notary may:
- Format customer-supplied legal citations
- Organize authorities selected by the customer or attorney
- Arrange customer-supplied arguments under headings
- Check basic citation consistency
- Place supplied arguments into the selected form
- Identify an apparent missing memorandum section
Lake Mead Mobile Notary does not:
- Conduct legal research
- Select statutes
- Select court rules
- Select cases
- Interpret legal authorities
- Determine the governing standard
- Apply law to facts
- Develop legal strategy
- Draft independent legal analysis
- Represent that supplied authority remains valid or controlling
A request requiring independent legal research or argument development must be referred for attorney review.
Declarations and Affidavits
A motion, opposition, or reply may rely on a declaration or affidavit describing facts known personally by the signer.
The customer should provide:
- Declarant’s name
- Relationship to the case
- Facts personally known
- Dates
- Events
- Documents referenced
- Location
- Requested signature format
- Notarial requirement when applicable
Lake Mead Mobile Notary may organize the customer’s factual statement and prepare the selected declaration format.
Lake Mead Mobile Notary does not:
- Decide who should serve as a witness
- Tell a declarant what facts to claim
- Create personal knowledge
- Sign for the declarant
- Backdate a declaration
- Represent hearsay as personal knowledge
- Determine admissibility
- Guarantee that the court will consider the declaration
Exhibits
Motion practice may involve supporting exhibits such as:
- Contracts
- Court filings
- Court orders
- Correspondence
- Emails
- Text messages
- Photographs
- Payment records
- Account records
- Discovery responses
- Receipts
- Notices
- Declarations
- Business records
- Other customer-selected documents
Exhibit preparation may include:
- Removing exact duplicates
- Rotating pages
- Ordering records
- Applying exhibit labels
- Preparing an exhibit index
- Combining related pages
- Separating unrelated records
- Creating filing-ready PDFs
- Adding customer-approved exhibit references
- Checking page sequence
Lake Mead Mobile Notary does not determine:
- Which exhibits are legally necessary
- Which evidence is admissible
- Which evidence is persuasive
- Whether an exhibit should be withheld
- Whether authentication is sufficient
- Whether confidential information must be filed under seal
- Whether an exhibit proves the requested relief
Confidential and Sealed Materials
The customer must identify records containing:
- Social Security numbers
- Financial-account numbers
- Medical information
- Minor children’s information
- Confidential business information
- Sealed court records
- Protected personal information
- Privileged communications
- Other restricted material
Lake Mead Mobile Notary may identify obvious sensitive information during administrative review.
Lake Mead Mobile Notary does not determine:
- Which information must be redacted
- Whether a filing should be sealed
- Whether privilege applies
- Whether confidential material may be disclosed
- Whether a separate motion to seal is required
Those questions may require attorney or court guidance.
Proposed Orders
Some motions require or permit a proposed order setting out the ruling requested from the court.
Depending on the current form and confirmed scope, proposed-order preparation may include:
- Court caption
- Motion title
- Requested ruling supplied by the customer
- Signature line for the judge
- Date line
- Distribution information
- Customer-supplied findings or terms
- Filing-ready formatting
Lake Mead Mobile Notary does not determine what findings, legal conclusions, or relief the judge should enter.
The court may:
- Sign the proposed order
- Modify it
- Prepare a different order
- Direct a party to revise it
- Deny the motion
- Take the matter under submission
Notice of Motion and Hearing Information
Las Vegas Justice Court motion practice may require specific notice language and hearing information.
The notice may include:
- Motion title
- Date
- Time
- Department
- Hearing location
- Remote appearance information
- Opposition warning
- Other language required by the current local rules
The applicable form and current rules must be verified before filing.
Lake Mead Mobile Notary does not select the hearing date or guarantee that a requested hearing will be scheduled.
Motions Without an Immediate Hearing
Some motions may:
- Be decided on the written filings
- Be reviewed before a hearing is assigned
- Require the clerk or department to supply a hearing date
- Require delivery of a proposed order
- Use a specialized court procedure
The customer must provide current court instructions when the selected motion does not follow the ordinary motion-calendar process.
Certificates of Service
A motion, opposition, reply, or related filing generally must be provided to the other parties or their attorneys through the permitted service method.
A Certificate of Service may identify:
- Document served
- Date
- Delivery method
- Recipient
- Attorney
- Address
- Email when permitted
- Person completing service
- Signature
Current Las Vegas Justice Court rules require service of motion-practice documents and address the filing of service certificates.
Lake Mead Mobile Notary may type customer-supplied service information.
Lake Mead Mobile Notary does not:
- Determine the legally sufficient recipient
- Decide whether email service is permitted
- Sign for the customer
- Backdate service
- State that delivery occurred when it did not
- Perform formal service of process
- Guarantee delivery
Motion, Opposition, and Reply Deadlines
Motion-practice deadlines may depend on:
- Document type
- Date of service
- Method of service
- Hearing date
- Judicial days
- Business days
- Calendar days
- Court order
- Local rule
- Small claims procedure
- Post-judgment procedure
- Electronic service
- Mailing
- Other case-specific circumstances
Current Las Vegas Justice Court rules and self-help materials establish short periods for oppositions, replies, and service-related filings. The customer must confirm the exact deadline from the filed documents, current rules, court instructions, or qualified legal guidance.
Lake Mead Mobile Notary does not calculate, extend, preserve, or guarantee legal deadlines.
Electronic Filing
Las Vegas Justice Court requires electronic filing for its civil case types.
Electronic filing may require:
- Existing case number
- Correct case type
- Correct party
- Correct filing code
- Motion, opposition, reply, or response
- Supporting memorandum
- Declaration
- Exhibits
- Proposed order
- Certificate of service
- Hearing information
- Filing-fee authorization
- Customer email address
- Final filing authorization
Nevada Court E-Filing Submission remains a separate service unless expressly included in the confirmed preparation scope.
Electronic submission does not guarantee:
- Immediate acceptance
- Correct filing classification
- A hearing
- Consideration on the merits
- No technical rejection
- The requested ruling
- Preservation of every argument
Motion to Set Aside Default or Judgment
A request to set aside default or default judgment may involve:
- Date default was entered
- Date judgment was entered
- Method of service
- Date the customer learned of the case
- Customer’s explanation
- Proposed response to the underlying complaint
- Supporting declaration
- Supporting records
- Current enforcement activity
- Garnishment
- Execution
- Hearing information
- Legal grounds supplied by the customer or attorney
A motion to set aside may be time sensitive and may require a legally sufficient ground.
Lake Mead Mobile Notary does not determine:
- Whether default was properly entered
- Whether service was valid
- Which ground applies
- Whether the customer acted promptly
- Whether a meritorious defense exists
- Whether enforcement will stop
- Whether a stay is needed
- Whether the motion will be granted
Summary Judgment Motions and Oppositions
Summary judgment requests can potentially resolve an entire case or a major issue without trial.
These matters generally require:
- Identification of allegedly undisputed facts
- Supporting evidence
- References to the record
- Legal authorities
- Legal analysis
- Response to the opposing party’s factual statement
- Detailed procedural compliance
Current self-help guidance describes summary judgment as a complicated and potentially case-determinative procedure.
Lake Mead Mobile Notary may provide administrative preparation only when the customer or qualified attorney supplies the legal grounds, authorities, factual positions, and evidence references.
Independent preparation of summary judgment legal analysis is outside the standard scope.
Discovery Motions
A motion involving discovery may concern:
- Failure to answer interrogatories
- Failure to produce documents
- Incomplete responses
- Protective relief
- Objections
- Admissions
- Deposition issues
- Sanctions
- Other discovery disputes
Discovery motions can require:
- Prior requests
- Responses
- Objections
- Correspondence
- Meet-and-confer records
- Applicable rules
- Court orders
- Customer-selected relief
Lake Mead Mobile Notary does not decide whether discovery was sufficient, whether an objection is valid, whether sanctions should be requested, or whether a motion is procedurally available.
Discovery-response preparation itself is outside this service.
Post-Judgment Motions and Responses
A post-judgment matter may involve:
- Satisfaction of judgment
- Release of execution
- Claim of exemption
- Objection to exemption
- Correction of judgment
- New trial
- Amendment of findings
- Relief from judgment
- Enforcement dispute
- Other customer-selected post-judgment relief
Post-judgment matters may affect wages, bank accounts, property, liens, or enforcement.
Lake Mead Mobile Notary does not determine:
- Whether property is exempt
- Whether judgment is satisfied
- Whether an execution should be released
- Whether a judgment can be set aside
- Whether an appeal should be filed
- Which post-judgment remedy applies
Small Claims Motion Practice
This page may support a customer-selected motion, opposition, or response in an existing Las Vegas small claims case when:
- A current court form exists
- The customer identifies the requested relief
- The procedural stage is clear
- The preparation remains administrative
- The matter does not require Lake Mead Mobile Notary to provide legal advice
Potential small claims matters may involve:
- Continuance request
- Motion to place on calendar
- Motion to set aside default
- Motion to set aside dismissal
- Mediation-related motion
- Opposition to a filed motion
- Satisfaction of judgment
- Other current court-approved form
Small Claims Document Preparation and E-Filing owns the plaintiff’s initial case-opening workflow. This page owns later customer-selected motion practice.
Eviction-Related Motions
Eviction-related motions may involve exceptionally short deadlines and immediate possession issues.
A request involving:
- Motion to stay
- Motion to set aside eviction order
- Post-lockout relief
- Appeal from an eviction decision
- Emergency request
- Constable enforcement
- Existing removal order
requires separate qualification and may be declined or referred for immediate self-help or attorney assistance.
Tenant Summary Eviction Answer Preparation remains the correct service for a tenant responding to the original eviction notice before an order is entered.
Protection Orders, Appeals, and Writs
This service does not ordinarily cover:
- Protection-order applications
- Opposition to a protection order
- Motion to dissolve or extend a protection order
- Appeal
- Appellate brief
- Petition for judicial review
- Writ petition
- Emergency extraordinary relief
- Criminal motion
- Traffic motion
Those proceedings use specialized statutes, forms, deadlines, and court procedures.
Multiple Parties
When several parties are involved, the preparation must confirm:
- Which party is filing
- Which parties join the motion
- Which parties oppose
- Whether positions differ
- Which attorneys represent which parties
- Who must receive service
- Whether separate declarations are required
- Whether separate relief is requested
The standard scope assumes one filing party unless an expanded scope is accepted.
Lake Mead Mobile Notary does not decide whether parties should file jointly.
Business and Entity Parties
A corporation, limited-liability company, partnership, trust, association, or other entity may be subject to representation rules different from those applying to an individual.
Lake Mead Mobile Notary does not determine:
- Whether an owner may represent the company
- Whether a member or manager may sign
- Whether a trustee may appear
- Whether attorney representation is required
- Whether an employee has authority
- Whether the entity is in good standing
- Whether an entity resolution is required
Entity-representation questions must be confirmed with the court or a qualified Nevada attorney.

Before You Start
Treat Motion Practice as Time Sensitive
Motions, oppositions, replies, and other responses may have short deadlines.
Do not wait for the hearing date before reviewing the filing requirements.
The customer must provide:
- Date the document was filed
- Date it was received
- Service method
- Hearing date
- Deadline stated in the document
- Current court instructions
- Any applicable court order
Lake Mead Mobile Notary does not calculate or guarantee deadlines.
Provide the Complete Filed Document
Do not submit only:
- First page
- Screenshot
- Hearing notice
- Docket entry
- Email summary
- One exhibit
- Attorney cover letter
Provide the complete filed motion, opposition, reply, notice, declaration, and every attachment.
The Customer Must Select the Motion or Response
Lake Mead Mobile Notary cannot decide whether the customer should file:
- Motion
- Opposition
- Reply
- Countermotion
- Answer
- Appeal
- Settlement document
- Bankruptcy filing
- Another procedural response
That decision may materially affect the case.
Define the Requested Relief
Do not use vague directions such as:
- Fix the case
- Dismiss everything
- Stop the other side
- Reopen it
- Make the judge reconsider
- Give me more time
- Release my money
The customer must identify the specific ruling requested or opposed.
Supply the Legal Grounds
A motion or opposition may require statutes, court rules, cases, or other legal authorities.
Lake Mead Mobile Notary does not research or select those authorities.
The customer should obtain them from:
- Qualified attorney
- Current self-help resource
- Law library
- Existing court form
- Prior attorney instructions
- Another reliable legal source independently selected by the customer
Facts Must Be Truthful and Customer Supplied
The customer is responsible for every factual statement.
Lake Mead Mobile Notary will not:
- Invent facts
- Alter dates
- Create an excuse
- Misstate service
- Conceal prior orders
- Omit adverse filings at the customer’s request
- Falsify communications
- Create evidence
- Sign a declaration for another person
Declarations Must Reflect Personal Knowledge
A declarant should state only facts the declarant can truthfully certify.
Lake Mead Mobile Notary does not determine admissibility or whether personal knowledge is sufficient.
Do Not Add Unrelated Issues to a Reply
A reply generally responds to matters raised in the opposition.
Introducing a new request, argument, party, or evidence may require additional review or a different filing.
Review Every Exhibit
Before filing, confirm:
- Exhibit is complete
- Pages are readable
- Dates are visible
- Names are accurate
- Private information is addressed
- Document was not altered
- Exhibit label matches the filing
- Customer approves its disclosure
Confirm Whether a Proposed Order Is Required
Some motions use:
- Court-prepared order
- Party-prepared proposed order
- Order submitted after hearing
- Separate Notice of Entry of Order
- Specialized court form
The customer must provide or obtain the current procedure.
Filing Does Not Complete Service
Submitting the document to the court and providing it to the other parties are separate responsibilities.
The customer must confirm:
- Recipients
- Attorneys
- Addresses
- Permitted service method
- Service date
- Certificate requirements
Electronic Filing Does Not Guarantee Acceptance
A filing may be rejected because of:
- Wrong case number
- Wrong filing code
- Missing signature
- Missing memorandum
- Missing declaration
- Missing exhibit
- Incorrect PDF
- Missing service information
- Incorrect fee
- Other technical or substantive issue
Material revision and resubmission are not automatically included.
A Filed Motion Does Not Guarantee a Hearing
The court may:
- Decide the motion on the papers
- Deny it without a hearing
- Set a hearing
- Continue the matter
- Request supplemental information
- Require another filing
- Prepare its own order
- Direct a party to prepare an order
Filing a Motion Does Not Stop Existing Deadlines
Unless the court enters an order providing otherwise, another case deadline, collection action, hearing, or enforcement step may continue.
Lake Mead Mobile Notary does not determine whether filing creates a stay.
Default and Judgment Matters Require Immediate Review
A request involving default, judgment, garnishment, execution, or collection may be urgent.
Provide every judgment, notice, writ, garnishment document, and enforcement record.
Summary Judgment Requires Elevated Review
Summary judgment can decide all or part of a case without trial and typically requires substantial factual and legal analysis.
Lake Mead Mobile Notary does not independently create that analysis.
Discovery Disputes Require Complete Records
Provide:
- Original discovery request
- Responses
- Objections
- Correspondence
- Court orders
- Meet-and-confer records
- Customer-selected relief
Lake Mead Mobile Notary does not determine whether discovery was adequate or whether sanctions apply.
Emergency and Ex Parte Requests Require Professional Review
A request to obtain relief without ordinary notice or on an emergency basis may involve heightened factual, procedural, and legal requirements.
Lake Mead Mobile Notary does not determine whether emergency or ex parte relief is available.
Eviction Motions Require Immediate Qualification
A motion involving an existing eviction order, constable posting, lockout, stay, set-aside request, or appeal should not be treated as ordinary motion preparation.
The customer may need immediate attorney or self-help assistance.
Business Entities May Require Counsel
Do not assume an owner, manager, officer, member, trustee, employee, or registered agent may represent an entity in court.
